This Papua New Guinea Evidence Handbook with Common Objections & Evidentiary Foundations contains not only the Papua New Guinea Evidence Act with amendments and the Criminal Practice Rules on evidence, but also an 80-page appendix (the "added value" to this book) with a 16-page section on making and responding to common objections - including a discussion of the 15 most common objections and a list of 60 common trial objections - and 60+ pages on evidentiary foundations and impeachment - including 25 examples of foundations for introducing physical, electronic, hearsay, and social media evidence, a discussion on differing standards for authenticating digital evidence, and sample impeachment transcripts. Although the appendix refers to the U.S. Federal Rules of Evidence, we do not suggest that those U.S. rules apply in PNG. However, we believe those materials can be helpful when working with evidence issues in PNG. The appendix materials are offered with the benign and friendly intent to help you shape PNG practice.

John Barkai is a former Detroit Michigan criminal trial lawyer and a full-time law professor for 50 years. His students, under his supervision, have represented real clients in real cases for 50 years. He has taught evidence since 1981, been the director of his law school's clinical law program since 1978, and been a member of the Hawaii Supreme Court's Evidence Committee for 30 years. This handbook, and his other 65+ other jurisdictions handbooks, were inspired by handbooks he created for a workshop for Pacific Island judges from American Samoa, Marshall Islands, Federated States of Micronesia, Chuuk, Kosrae, Pohnpei, and Yap. He has published similar evidence handbooks for all 50 American states as well as for 15 other jurisdictions from American Samoa to the U.S. Virgin Islands.

Michael Wagambie is from PNG. He is a lawyer and academic with a law degree from PNG Law School and a dual Masters in Conflict Management and Resolution and Business Administration from James Cook University in Townsville, Australia. He has been a lawyer in PNG since 2000 and is currently the principal of M.S. Wagambie Lawyers in Port Moresby where he specializes in Civil practice and Criminal Defence. He also teaches Criminal Law, Trial Practice and Criminal Procedure, and Law of Evidence at PNG Law School.

Alice Areori is from PNG. She has a law degree from PNG Law School and will complete her Master’s in Law Degree at the University of Hawaii Law School in May 2023. She took Professor Barkai’s Prosecution Clinic class as part of her master’s program and had the opportunity to appear in the Honolulu District Court where she tried traffic and minor criminal cases under the Hawaii student practice rule. She has worked for a conveyancing and commercial law firm in PNG and with the National Justice Project in Sydney Australia. She is a recipient of the 2023 Edinberg’s Commonwealth Study program focused on bringing 300 of the world’s most promising emerging leaders from business, government, and the community sector to undergo experiential leadership training in Canada. Alice has great passion for human rights and her interest lies in International Human Rights and Conflict Resolution.
